Ashish Mahendru Quoted in Texas Lawbook on FLSA Litigation During COVID-19

HOUSTON – Houston trial lawyer and Mahendru P.C. founder Ashish Mahendru recently sat down with Texas Lawbook to discuss the rise in lawsuits tied to the Fair Labor Standards Act (FLSA) in Texas.

The September 1 article, “Wage and Hour Litigation Back on the Rise in Midst of COVID-19,” focuses on recent data showing that FLSA lawsuits filed across Texas federal courts during the first half of 2020 were up 16 percent and up 19 percent from the second half of 2019.

Employment law experts such as Mr. Mahendru indicated they expect to be occupied with more FSLA lawsuits as companies continue to lay off workers due to the economic fallout of COVID-19.

In the article, Mr. Mahendru stated that FLSA claims will only increase and that current numbers do not fully reflect the sheer volume of layoffs occurring — and increased litigious behavior as a result.

“You have to give layoffs time to take effect, and you have to give the rounds of unemployment benefits time to play themselves out,” he said. “You have to give the plaintiffs’ bar time to troll or pick and find plaintiffs, and then once that dust effectively settles, you get a filing.”
